1. Installation of traffic
signals in Wellington Estates:
DeLuca completed their obligation as required according to
the approved site plan. The site plan approved by Bensalem
and the D.O.T. (Dept of Transportation) did not require
traffic signals other than where installed at Essex Drive
and Street Road. In the future, a traffic signal will be
installed at Gibbs Road and Rt. 13 (approved by the above
agencies).
2. Stop signs and speed bumps:
DeLuca completed their obligation as required
according to the approved site plan. The site plan approved
by Bensalem and the D.O.T. (Dept of Transportation) does not
require any additional stop signs nor does it require the
installation of speed bumps.
3. Rte. 13 and Gibbs Road Intersection:
DeLuca attempted to complete this intersection and the Rt. 13 improvements over the past few years but was stopped by a local politician and by the D.O.T. DeLuca ordered the material to complete this work, had some of the material delivered to the site but was put on hold until further notice by no fault of their own. The local business owners on Rt. 13 are objecting to the closure of Rt. 13 to complete these improvements.
4. Make Wellington a Gated
Community:
DeLuca completed their obligation as required
according to the approve site plan. This is not a DeLuca
responsibility. If the h/o's would like to attempt to make
Wellington a "gated community" it is the h/o's
responsibility (I believe that this is not permitted in
Bensalem) from all governmental agencies. If this was ever
approved which I doubt, this will cause the increase of dues
to the WHOA (professionals, consultants, engineers, street
maintenance, etc.) and require additional
attention/maintenance to the HOA.
5. Residential lawn maintenance:
This is not DeLuca's
responsibility. The h/o need to contact Continental Property
Management and the WHOA. If the WHOA does not have any
approved regulations it is not DeLuca's responsibility. The
h/o's can also contact Bensalem Township to report a
violation to the residential ordnance.
6. Road paving:
Bensalem Township requires
that all new construction communities be "final paved" upon
completion of all construction within the community. DeLuca
attempted to complete the final asphalt paving to Phase 1 in
the past but was denied by the township. Bensalem Township
is holding an escrow provided by DeLuca Homes to complete
this responsibility as well as escrows to complete all
improvements required by the site plan for Wellington
Estates.
7. School Bus:
The Bensalem Township
School district is responsible for approving all school bus
transportation. The School District does not permit any
school bus traffic within a community that is not dedicated.
Wellington Estates is not dedicated, thus, this is not a
DeLuca responsibility. Dedication to the township would be
completed once construction is completed and all
improvements are accepted by the township.
